Patent: The exclusive right granted by the government to an inventor to manufacture, use, or sell and
invention for a certain number of years. So why run an article on patent infringement? Mainly because
patents are misunderstood and many times infringements occur without the realization that a law has
been broken.
The nature of entrepreneurship is to create better mousetraps and in doing so it is easy to recognize a
good idea as being a good idea and look for ways to capitalize by improving on an established product or
service.
Years ago it seemed to be common place for the portable restroom manufacturers to banter between
themselves on what components of a portable toilet were covered under patents and which ones weren’t.
Largely it was left to the court system to sort out all the details and make a determination. Today,
patent infringement and protection plays a significant role in the manufacturing sector of the portable
sanitation industry.
Making headlines is rectangle tank manufacturer “Crescent Tank” who holds a patent on his product and
displays their patent number on all their advertising regarding the rectangular tank outfitted for use as a
portable toilet service vehicle. The display serves as a warning to others that certain components of the
design are protected and cannot be duplicated without written permission given by the inventor. Having
no expertise in the patent arena the Journal will not attempt to convey which areas are protected. The
complexities surrounding patents are often times defined in a legal arena when the patent holder believes
that an infringement has occurred.
Recently, Crescent Tank Manufacturing and a Maryland based manufacturer entered into a settlement
agreement. Both parties agreed that this particular manufacturer had infringed upon Crescent Tank’s US
Patent No. 6,598,242. The point of infringement occurred when the manufacturer had produced and
sold a flat tank.
“Crescent Tank has a unique, patented product that is based on more than ten years of research,
development, and testing. We have more than 300 units in the field to date,” explained Bob Denome who
owns Crescent Tank and holds the patent in question. “Crescent Tank relies on input from customers,
drivers, and maintenance personal to continually improve our original comprehensive tank design and
provide a user friendly, maintenance friendly value in the industry.”
Denome further stated, “Infringers put themselves and their customers at risk of substantial financial
losses. Infringers are liable for Crescent’s damages, such as lost profits. If infringement is willful and
the case is exceptional, a court may increase damages threefold and award attorney fees. It is also illegal
to use infringing products. Customers of infringers may also be responsible for damages and may be
enjoined from using the infringing product.”
Clarifying his position, Denome stated, “Crescent Tank will use all legal means available to defend its
patent and will continue to investigate all potential infringements. “It’s just like someone stealing from
you,” he said. “Know what you are buying and who manufactured the product. Don’t infringe or buy
from an infringer.”

FEBRUARY 15, 2011 CRESCENT TANK TAKES "CUSTOM" TO A WHOLE NEW LEVEL
We at Crescent Tank have always taken great pride in our ability to meet our

built truck that uses a traditional Crescent tank customized to work as a roll-off tank.
The solid sides were built to allow the driver to do garbage pick up with the totter tipper
on the passenger side and it still has the ability to carry equipment on the deck utilizing
the lift gate.
Also, we're proud to showcase this custom built vehicle used by a company that
collects vegetable oil waste and converts it into biofuel. The vacuum tank (16' length)
can hold 1,250 gallons of waste vegetable oil. The deck carries 25 barrels (55gallon).
